The Court confirms the unnecessity of an established right to build in the riverbed during the construction and operation of hydroelectric power plants
In March 2022, we informed you about the Supreme Administrative Court's Decision No. 2460 of 16 March 2022, by which the court declared legal and valid a building permit for a hydroelectric power plant, issued without an established right to build in the riverbed, which was previously challenged by the Prosecutor's Office. In May 2022, another chamber of the Supreme Administrative Court issued a second decision in the same direction - Decision No. 4238 of 04 May 2022.

The Supreme Administrative Court issued a second decision (Decision No.4238 of 04.05.2022 of the Supreme Administrative Court in Administrative Case No. 209 / 2022), which confirmed its practice in favor of the owners of hydroelectric power plants, in connection with the cases initiated at the request of the prosecutor's offices for revocation of their issued building permits.

Final Decision on the Dispute on the Legality of the Building Permits for the Construction of Hydroelectric Power Plants
In recent years, there has been a systematic practice of the heads of the RDNSK to refer to the Prosecutor's Office with reports of "illegal construction" regarding hydropower plants that do not have a construction right established by the Council of Ministers for construction in the riverbed. On the basis of these signals and their verifications, the Prosecutor's Office, in turn, protests construction permits for hydropower plants as invalid and seeks their annulment by the courts (both for hydropower plants under construction and those placed in service).
Are the contracting parties obligatory or optional necessary companions in the proceedings on a claim brought by a third party for nullity of the contract?
Silviya Spasova, Attorney at law, prepared an opinion in her capacity as rapporteur, appointed by the Supreme Bar Council on the interpretative case No. 7/2021 of the SCC on the following question: “Are the contracting parties obligatory or optional necessary companions in the proceedings on a claim brought by a third party for nullity of the contract?”. Contradictory case law has been found on the question.
